1. Acceptance of Terms  

• Users must be at least 13 years old (or meet their jurisdiction’s legal age).  

• Schools/Educators: See Section 12 for institutional use terms.

2. Account Registration  

• Keep login details secure. Notify us of unauthorized access.  

• Under 13? Parental consent required (see COPPA Section 11).

3. User-Generated Content (UGC)  

• You grant Playstruck a license to use submitted content (reviews, videos, etc.).  

• Prohibited:    

  • Illegal, abusive, or copyrighted material (DMCA claims: hello@playstruck.com.    

  • Malware, spam, or impersonation.  

  • We may remove UGC and ban violators without notice.

4. Sales & Refunds   

• Physical Goods  

  • Shipping: Processed in 10 days; delivery times vary.  

  • Returns: Unopened items refundable within [30 days]. Customer covers return shipping unless the error is ours.   

• Digital Goods  

  • No refunds for downloaded content (games, software, courses). Defective? Contact us within 10 days.

5. COPPA (Children’s Online Privacy)  

• Playstruck does not knowingly collect data from children under 13 without parental consent.  

• Parents/Guardians: To request data deletion or revoke consent, email hello@playstruck.com.  

• Schools: May provide consent for student accounts under FERPA guidelines (see Section 12).

6. Schools & Educational Use  

• Educators may create accounts for students with parental consent (for under-13 users).

• School Responsibilities:    

  • Ensure compliance with COPPA and FERPA.    

  • Monitor student activity on Playstruck.  

• Limited License: Schools may use Playstruck solely for non-commercial educational purposes.

8. Jurisdiction & Disputes  

• Governing Law: New York and California laws apply.  

• Arbitration: Disputes resolved individually (no class actions).  

• CA Residents: Waive rights under CA Civil Code §1542 (unknown claims).

Playstruck is not liable for:  

• Indirect damages (e.g., lost profits).

• Third-party content or service interruptions.
