These Terms govern your use of the PLAYSTRUCK website, products, assessments, and services. They're written to be readable. Please take a few minutes — using PLAYSTRUCK means

agreeing to them.

1. Agreement & Eligibility

These Terms of Service ("Terms") are a binding agreement between you and PLAYSTRUCK LLC ("PLAYSTRUCK," "we," "us," or "our"). By accessing playstruck.com, purchasing our products, taking our assessments, or using any related service, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use our services. You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase or create an account.
 

2. Accounts

If you create an account, you're responsible for keeping your login credentials confidential and for activity that happens under your account. Notify us immediately at hello@playstruck.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms or are used for fraud or abuse.

3. Intellectual Property & Trademarks

All content on PLAYSTRUCK platforms — including text, design, photographs, illustrations, assessments, methodology, the certification rubric, and software — is owned by PLAYSTRUCK LLC or our licensors and is protected by copyright, trademark, and other intellectual property laws.

PLAYSTRUCK™, Playtool™, Playtools™, The Doodle Challenge™, Key Level Score™, KLS™, The Well Played Life™, IEER™, Multiminded Design™, and Playoritization™ are trademarks of PLAYSTRUCK LLC. Our methodology, eight-point design criteria, and certification standards are proprietary. You may not use our marks, replicate our methodology, or claim to certify against our standards without prior written permission. Unauthorized commercial use will be enforced under applicable law.

4. Limited License To Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our website, assessments, and digital products for personal, non-commercial use, consistent with these Terms. This license does not permit you to: (a) resell, reproduce, or republish our content; (b) reverse-engineer the assessments or methodology; (c) use our services to train AI models or build competing offerings; or (d) remove proprietary notices from any materials.

5. Purchases, Pricing & Payment

All prices are listed in US Dollars unless otherwise stated. We may change prices at any time, but the price you saw at the time of purchase is the price you pay. Payment is processed by trusted third-party payment processors; we do not store full payment card numbers. You're responsible for any applicable taxes or duties.

6. Returns, Refunds & Cancellations

• Physical Playtools™: returnable within 30 days of delivery if unused and in original packaging. Customer pays return shipping unless the item arrived defective or incorrect.

• Assessments & digital products (KLS™, Well Played Life™, the free mini-assessment, downloadable content): non-refundable once accessed or completed.

• Bulk, licensing, certification, and custom consulting engagements: governed by separate written agreements, including refund and cancellation terms specific to each contract.

• Subscriptions (Companion App, etc.): cancel anytime from your account; access continues through the end of the paid billing period. No partial-period refunds.

7. Assessments Are Not Medical Or Mental Health Advice

PLAYSTRUCK assessments — including KLS™, The Well Played Life™, and the free mini-assessment — are research-informed self-discovery tools. They are not diagnostic, not medical advice, not a substitute for professional mental health care, therapy, or medical treatment, and are not intended to identify, diagnose, treat, cure, or prevent any condition.

If you are experiencing distress or a mental health emergency, please contact a licensed professional or one of the following resources:

• Crisis Text Line (US — text HOME to 741741)

• 911 (US emergencies) or your local emergency services

8. User-Generated Content & Feedback

If you submit feedback, suggestions, testimonials, photos, or other content to PLAYSTRUCK (collectively, "Submissions"), you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, adapt, and display that content in connection with our business — including marketing — unless you tell us otherwise in writing. You represent that you have the rights to share any Submission, and that it doesn't violate anyone else's rights or applicable law.

9. Prohibited Conduct

You agree not to:

• Use our services for any illegal purpose or in violation of any law.

• Scrape, crawl, or harvest data from our site without written permission.

• Reverse-engineer our assessments, methodology, or software.

• Use our services to train AI/ML models or to build a competing product or methodology.

• Misrepresent yourself as affiliated with, endorsed by, or certified by PLAYSTRUCK if you are not.

• Interfere with the operation, security, or integrity of our services.

• Submit false, defamatory, harassing, or abusive content.

10. Third-Party Sites & Services

Our services may link to third-party sites or integrate with third-party tools (payment processors, shipping carriers, analytics, email delivery). PLAYSTRUCK is not responsible for the content, policies, or practices of any third party. Your interactions with third parties are governed by their own terms and policies.

11. Disclaimers

Our services, products, and assessments are provided "as is" and "as available," without warranties of any kind — express or implied — including (to the fullest extent allowed by law) implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, secure, or error-free, or that any results obtained will meet any particular expectation.

12. Limitation Of Liability

To the fullest extent permitted by law, PLAYSTRUCK LLC, its officers, directors, employees, contractors, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of our services. Our total aggregate liability for any claim arising under these Terms will not exceed the greater of (a) the amount you paid PLAYSTRUCK in the 12 months preceding the claim, or (b) US $100.

13. Indemnification

You agree to indemnify, defend, and hold harmless PLAYSTRUCK LLC and its affiliates from any claims, damages, costs, or expenses (including reasonable attorneys' fees) arising from (a) your breach of these Terms, (b) your misuse of our services, or (c) your violation of any law or third-party right.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Before filing any formal legal claim, you agree to first contact us at legal@playstruck.com and attempt to resolve the matter in good faith for at least 60 days. Any unresolved dispute will be brought exclusively in the state or federal courts located in New York and California, and you consent to personal jurisdiction there. Both parties waive any right to a jury trial.

15. Termination

We may suspend or terminate your access to our services at any time, with or without notice, for any conduct we reasonably believe violates these Terms or is otherwise harmful to PLAYSTRUCK, our users, or third parties. Sections relating to IP, disclaimers, limitation of liability, indemnification, and governing law survive termination.

16. Changes To These Terms

We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent change. For material changes, we'll notify you by email (if you have an account) or with a prominent notice on the site before the changes take effect. Your continued use of our services after the effective date constitutes acceptance of the updated Terms.

17. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with our Privacy Policy and any separate written agreements you've signed with PLAYSTRUCK (bulk, licensing, consulting, certification), make up the entire agreement between you and PLAYSTRUCK regarding our services.
